On Tuesday the U.S. Supreme Court upheld a voter-approved Michigan law that banned racial preferences in higher education admissions. The court emphasized that it was not deciding the larger and divisive question of whether affirmative action admission policies can be lawful. Justice Anthony Kennedy wrote, "This case is not about how the debate about racial preferences should be resolved," he says, "It is about who may resolve it."
